Nikki Torain Plaintiff, vs. Esau Porter; Nunzia Point; and Helen Point Defendants. Jury Trial Requested) The Plaintiff; complaining of the Defendant, alleges: 1. The Plaintiff is a citizen and resident of Richland County, South Carolina. 2. The Defendant Esau Porter upon information and belief is a citizen and resident of Richland County, South Carolina. 3. The Defendant Nunzia Point upon information and belief is a citizen and resident of Georgetown County, South Carolina. 4. The Defendant Helen Point upon information and belief is a citizen and resident of Georgetown County, South Carolina. 5. The parties hereto, the subject matter hereof, and all things and matters hereinafter alleged are within the jurisdiction of the Honorable Court. 6. On or about the 15th day of August, 2015, the Plaintiff was travelling on Bush River Road in Richland County, Columbia, South Carolina. 7. The Plaintiff was stopped at the intersection. 8. The Defendant Esau Porter was operating a vehicle travelling behind the Plaintiff’s vehicle. 9. The Defendant Nunzia Point was operating a vehicle owned by the Defendant Helen Point. 10. The Defendant Nunzia Point’s vehicle was travelling behind the Defendant Esau Porter’s vehicle. 11. The Defendant Esau Porter’s vehicle struck the Plaintiff’s vehicle in the rear as the Plaintiff’s vehicle was stopped. 12. The Defendant Nunzia Point’s vehicle struck the rear of Defendant Esau Porter’s vehicle and causing the Defendant Esau Porter’s vehicle to strike the Plaintiff’s vehicle for a second time. 13. The Plaintiff’s vehicle sustained rear end damage. FOR A FIRST CAUSE OF ACTION 14. All the allegations in Paragraphs 1 through 13 are hereby incorporated herein as if they had been set forth fully hereunder. 15. The injuries and damages as hereinafter set forth were caused by the negligent and reckless conduct of the Defendant Esau Porter and Defendant Nunzia Point in the following particulars: a) In failing to maintain a proper lookout; b) In driving too fast for conditions; c) In failing to exercise that degree of care which a reasonably prudent person would have exercised under the same or similar circumstances; and d) In failing to maintain proper control of a motor vehicle. 16. As a direct and proximate result of both Defendants’ negligence, the Plaintiff suffered injuries to her head, neck, back, and body; furthermore, the Plaintiff’s injuries were of such a nature as to require her to expend monies for hospitalization, doctor’s care, other medical necessities, and to incur lost wages. 17. The Plaintiff has suffered and will continue to suffer great pain and mental anguish as a result of this collision. WHEREFORE, the Plaintiff prays judgment against both Defendants for actual damages and punitive damages in an appropriate amount, and for the costs of this action. FOR A SECOND CAUSE OF ACTION 18. All the allegations in Paragraphs 1 through 17 are hereby incorporated herein as if they had been set forth fully hereunder. 19. The injuries and damages as hereinafter set forth were caused by the negligent and reckless conduct of Defendant Helen Point in the following particulars: a) Negligent entrustment of her vehicle to the Defendant Nunzia Point. WHEREFORE, the Plaintiff prays judgment against the Defendant Helen Point for actual damages and punitive damages in an appropriate amount, and for the costs of this action.
