UNDER AN ORDER OF SALE for foreclosure issued on a Complaint made June 7, 2012, by Riverwood II Homeowner’s Association, Inc., against the above-named Defendant, Court of Common Pleas for Georgetown County, South Carolina.
THE MASTER will sell at public venue in the Georgetown County Courthouse, Georgetown, South Carolina at 12:00 p.m. on Sales Day, June 3, 2013, the lands hereinafter described on the following terms: TO THE HIGHEST BIDDER, but before the bid is accepted, bidder will deposit to the Master in cash or certified check, the sum of Five (5%) Percent of bid, to be deposited with the Master immediately, with the balance to be remitted within thirty (30) days after the sales day (but shall not apply to a bid placed by the Plaintiff). THE PROCEEDS OF SALE shall be applied to the costs allowed, and the debts found due; and to other payments found due in the Final Order. The Purchaser will pay for stamps and papers and any unpaid real or personal property taxes.
The sale shall be subject to that certain first mortgage to JPMortgage Chase Bank, N.A., in the original amount of $80,000.00, which was filed in the Office of the Register of Deeds in Georgetown County, South Carolina on May 4, 2005, in Mortgage Book 1642, Page 139 and Second Mortgage to Wachovia Bank, National Association n/k/a Wells Fargo Bank, N.A. in the original amount of $55,500.00, which was filed in the Office of the Register of Deeds in Georgetown County, South Carolina on April 3, 2006, in Mortgage Book 6236, Page 2908. The sale will be made subject to all outstanding property taxes, if any.
THE PROPERTY is situate in Georgetown County, South Carolina, and is more particularly described as follows:
Unit 4370-D Crepe Myrtle Court, Riverwood II HORIZONTAL PROPERTY REGIME, PHASE C, established pursuant to the South Carolina Horizontal Property Act, Sections 27-31-10 et seq., South Carolina Code of Laws, 1976, as amended, and submitted by Master Deed dated August 26, 1997, and recorded August 26, 1997, in the Office of the RMC for Georgetown County in Deed Book 801 at pages 22-116, as amended, as shown upon plans for Riverwood, and which plans are recorded in the Office of the RMC for Georgetown County in Plat Slide 236 at pages 2 and 3; said Dwelling is situate and is more fully described on a survey prepared by Survey Technology, Inc., dated August 12, 1997, and recorded in Plat Slide 243 at page 9, records of Georgetown County, said plat being incorporated by reference herein as a part of this description.
Subject to all the provisions of the Master Deed, dated August 26, 1997 and recorded in the Office of the RMC for Georgetown County, South Carolina, in Deed Book 801 at Pages 26-116, and as amended.
Subject to all the provisions of the Declaration of Covenants, Conditions and Restrictions for Riverwood Community Services Association, Inc. dated June 27, 1997, and recorded July 1, 1997 in Deed Book 786 at Page 126, as amended, Georgetown County records.
Together with all of the appurtenances thereto according to said Master Deed, as amended, and Declaration of Covenants, Conditions and Restrictions, as amended and the Grantee(s) assume and agree to observe and perform their obligations under said Master Deed, as amended, and Declarations of Covenants, Conditions and Restrictions, as the Grantee(s) Assume and agree to observe and perform their obligations under said Master Deed, as amended, and Declaration of Covenants, Conditions Restrictions, as amended, including but not limited to the payment of assessments for the maintenances and operation of the Common Area, dwelling and condominium.
And subject to the provisions of the By-Laws of the Riverwood IV Homeowners Associations, Inc. Riverwood Community Services Association, Inc. and to all other reservations and restrictions of record, easements, zoning ordinances, rights of way of record, including those as set out on the aforesaid map and taxes for the current year.
This being the identical property conveyed unto Mary Jo Robbins from Secretary of Housing and Urban Development, of Washington, DC., a/k/a United States Department of Housing and Urban Development, and agency of the United States of America by deed dated April 11, 2005 and recorded May 4, 2005 in Deed Book 1642 at Page 139, records for Georgetown County, South Carolina.
This being the identical property conveyed onto Mary Jo Robbins and Stephen R. De Mek from Mary Jo Robbins by deed dated April 15, 2005 and recorded May 4, 2005 in Deed Book 1642 at Page 144, records for Georgetown County, South Carolina.
